Alleged unrest instigator Bonginkosi Khanyile's bail was reinstated following his failure to appear in court on Monday.
The National Prosecuting Authority (NPA) in the province said Khanyile appeared in the Durban Magistrate's Court on Wednesday for an enquiry into his failure to attend court.
He is charged with incitement to commit public violence as well as charges of contravention of the Disaster Management Act, relating to the unrest that took place in KwaZulu-Natal in July 2021.
"His appearance is as a result of his failure to appear in court on Monday, 03 March 2025, where trial proceedings in the above matter were set to get underway," explained Natasha Ramkisson- Kara.
"A warrant of arrest was subsequently issued for his arrest, and he was arrested on March 4, 2025.
"Following the enquiry, the court reinstated his bail, after its provisional forfeiture."
Ramkisson-Kara said the court's condition was that the trial starts on Thursday, March 6, 2025.
The State alleges that between July 8 and July 11,2021 at or near Warwick Avenue in Durban, Khanyile unlawfully and intentionally incited, instigated, commanded or procured persons unknown to the State to commit public violence.
It is further alleged that on July 10, near Smith Street, Durban, he convened a gathering to address the nation which was not for purposes of a funeral or work.
Khanyile is out on R5,000 bail.
